Fiancé Visa Program Requirements in a Nutshell

One of the perks of U.S. Citizenship is the ability to bring a foreign fiancé(e) to the U.S. to get married, and then have him/her remain in the U.S. after the wedding.

 

The newlywed spouse is not required to return to his/her native country. This program is not available to fiancé(e)s of lawful permanent residents.

 

 U.S. Citizens may also petition their same-sex fiancé(e).

 

The fiancé visa program consists of two steps : the fiancé petition (Form I-129F) and the K-1 visa (fiancé visa). The entire process can take 6 months to 1 year, and petitions are processed in the order they are received. Thus, the sooner the couple applies, the sooner they can get married.

 

Once the process is complete, the newlyweds no longer have to be apart!

What are the program’s requirements?

  • Petitioner must be a U.S. citizen
  • The couple must intend to marry within 90 days of the foreign fiancé(e)’s entry into the U.S. on the fiancé visa
  • The couple must both be free to marry, i.e., any previous marriages must have been legally terminated
  • The couple must have met in person at least once within the past 2 years (although there are limited exceptions, such as for long-established customs that do not allow a couple to meet before marriage, or for extreme hardship)
  • The foreign fiancé(e) must undergo a medical examination by an authorized panel physician
  • Evidence of adequate financial support must be provided: self-sponsorship or support by U.S. Citizen fiancé(e)
  • Supplemental documentation evidencing the couple’s relationship and intention to marry must be provided
  • The foreign fiancé will be interviewed at a local U.S. Embassy abroad
